Non-Opposition, Re: the above, with provisos.
iSmile, via Dental Management Dynamics, LLC, came before our RCO and we
adopted the same provisos as we included for a similar business located in the
same shopping Center. Our Association
voted unanimously not to oppose with the following agreed upon provisos:
1. Join and maintain Membership within the Mayfair Business
Association;
2. The outside of your establishment must be kept clean, maintained, graffiti
free, and swept at all times;
3. Signage to be kept to a minimum:: No
nailing of banners to the walls, No excessive signage in the windows (all windows
should be easily seen through at all times), Grand Opening signs, flags,
garland, streamers to be removed within 30 days of store opening;
4. Add and maintain an outdoor trashcan;
5. Snow removal to be done within 6 hours of the storm, and during business
hours;
6. Contact information (Name - Phone Number - Email) to be provided to the
Mayfair Civic Association for the tenant, as well as the property owner /
landlord, and property manager;
7. Notify the MCA and Mayfair Business Association that you are seeking new
hires and hire within the community if possible; and
8. Zoning runs with the applicant and reverts back to its
original usage should applicant vacate the premises
Additionally,
9. No Methadone shall
be dispensed;
10. Medical waste
will be disposed of properly, according to State and Federal regulations, by a
certified medical waste removal company;
11. Regular waste will be disposed of properly; and
12. Upon surrendering
the premises, Applicant will petition the Zoning Board to remove the variance
for the property so that it reverts back to its original use; and

Please
accept this letter on behalf of the Mayfair
Civic Association (“MCA”) which
represents the neighbors of the Mayfair Community as their Registered Community
Organization (RCO) as a formal request for a continuance. We originally held a much divided meeting for
this applicant at the Mayfair Community Center, 2990 St. Vincent St on Monday, September
21, 2015 at 7PM at the Mayfair Community Center (2990 St. Vincent Street). At this meeting several neighbors voiced
their concerns as well as support for this project. Some issues that arose were the Applicants
misrepresentation of facts about their dealings with the Zoning Chair of the
RCO and how they tried to coordinate a time to visit the property prior to the
meeting but left out that the Zoning Chair promptly responded and asked for
suggested dates and times. Several weeks
later Applicant responded but it would have been too difficult to corral the volunteer
MCA Board members at such a late day.
Another issue that arose was that said property was shut down via a
cease and desist order for operating illegally.
Nevertheless, a vote was taken and the vote was recorded 10 votes for
not opposed with provisos and nine for opposed.
Immediately after
the community meeting, but prior to sending out the letter to the Zoning Board,
we were contacted by fourteen (14) concerned neighbors who live adjacent to the
property and whose addresses were supposed to be notified prior to the meeting,
as well as ten (10) who live in close proximity) who stated that they had not
received notice of this meeting (attached herein). The MCA prides itself on
having a very open and transparent dialogue with our neighbors and we hold
ourselves accountable for relying and trusting in the verbal report of the
zoning expeditor and the applicant. We are asking for a continuance as the
legitimacy of the applicant's claim regarding proper notification conflicts
with the neighbors’ reports. Should you choose not to continue this case, we
therefore, in the alternative as that you deny the applicant for the reasons
stated above. Nevertheless, should you decide to
hear the case and rule in favor of the applicant, we ask that the following
proviso be included as was agreed upon by the applicant.

Organization (RCO) as a Letter of OPPOSITION for the above referenced property.
A meeting for this applicant was held at the Mayfair Community Center, 2990 St.
Vincent St on Monday August 3, 2015, at 7:30PM. At this meeting, the MCA
unanimously vote to OPPOSE this application due to the high number of existing
duplexes and triplexes oon that block as well as the increased amount of
landlords from outside the area. The
meeting was attended by roughly Twenty Five neighbors from the 3500 block of
Vista St and strongly opposed this.
Thereafter we took a vote and it was unanimously opposed. The applicant was promptly notified of our
decision at the conclusion of their presentation at the meeting.
