Re: Appeal for Use Variance at 3052 Fanshawe St - Variance for Two Family Dwelling
Attorney: Jim DeMarco
Dear Ms. Chapman
Please accept this letter on behalf of the Mayfair Civic Association (“MCA”) which represents the neighbors of the Mayfair Community as a letter of Opposition, Re: the above. The MCA heard facts from the owner, his attorney and several neighbors and took the following vote: Not Opposed – One, Not Opposed with Provisos – Nine and Opposed – Nineteen and issued our decision for the following reasons:
1. Owner failed to properly shovel the above corner property several days following a major snowstorm causing a severe inconvenience to many of the surrounding neighbors (Attached as “Exhibit A”),
2. Residents have grown accustomed to this property serving as a single family residence and would like to see it remain the same,
3. Owner, or tenant, erected a very large shed without approval from the City causing for poor visual guidance to residents exiting the shared driveway. Such structure was subsequently removed by force of the City (Attached as “Exhibit B”),, and
4. Three Violations with the City Of Philadelphia including 393711 Violation: CLIP VIOLATION NOTICE, and Violation: LICENSE - RENTAL PROPERTY, 409047 Violation: PERM Z- NEW USE 365701 and Violation: PERM Z- NEW USE
Therefore, due to the reasons stated above, the MCA, i.e. the Controlling RCO for the neighborhood, asks this Zoning Board of Adjustment, to deny the request for variance.
