The owners and management of Mayfair Tire have come before the civic and business communities in Mayfair and presented their case and both communities stand behind the continuance of this business. We only have two provisos at this time: 1) join and become an active member of the MBA and put out potted plants/shrubbery in the front of the building for beautification purposes. Mayfair has continuously proven that is a great place to have a business and we happy to aid Mayfair Tire in their endeavor.

- Join and participate in the Mayfair Business Association.

- More than just the words “Check Cashing” on the sign i.e. make it look nice.

- Upkeep and beautification of the property including potted plants/trees and/or flowers.

Please accept this email as the Mayfair Civic Association's opposition to the above referenced property. We have never heard from the owner as to his plans for the property. Also, as is custom in Mayfair, we are against changing single dwellings to duplexes as it creates an opportunity for absentee landlordism which is not the type of business we are looking to attract. Finally, when we were notified that the applicant was going for a variance, we promptly contacted him at the number listed on the application and never heard back. Therefore, we ask that you deny their application or at least, in the alternative, grant a continuance so that the owner can bring the Civic Association up to speed as they neglected to take any proper steps prior.
Please note, that this body was notified at 9:25am that this hearing was at 9:30am.

Please accept this letter as a proviso letter re the above on behalf of the Mayfair Business Association (“MBA”) and Mayfair Civic Association (“MCA”). We \have now had two opportunities to meet with the above owners and with the owners of neighbor, Party Time Deli. At first we were inclined to deny any request by the above for any type of variance as we felt they were pleading ignorance with respect to the type of business they were running. We felt they we were not entirely on the same page with the owners and even felt a bit troubled with some of what we had been hearing in the neighborhood. Nevertheless, we took it upon ourselves to schedule another meeting to clear the air.

We met last evening, October 5, 2009 at the John Perzel Community Center. Attendees included me; Mike Scotese, President of the MBA; the above and representatives from Party Time Deli. Several issues arose such as the selling of drug paraphernalia, selling cigarettes and tobacco products below the state minimum, intentionally undercutting the business of Party Time and lack of a concise business plan. The debate was spirited at times and accusations of who is a liar were made. Nevertheless, the group seemed pleased that the above own the building and will be living the in the attached building once the current leases expire. Therefore, the MCA and MBA will agree to a variance for takeout coffee if the following conditions are met:

- They will join and become active members of the MBA

- They come before the MBA and MCA if they plan to request any more permits for their business.

- They refrain from selling groceries

- They refrain from selling meats and cheeses

- They have Branded signage i.e. Neelam’s Coffee not just “Coffee”

- The beautify the property with either shrubbery or planted flowers

- They limit signage to business name and standard coffee shop operations.

- They refrain from selling any drug paraphernalia and/or blunts, rolling papers, pipes, etc.

- They sell no products below the state minimum including cigarettes.

Wit or Witout Cheesesteaks appears to be the type of business that our organizations would gladly welcome to our community. However, when establishing a structure for our organizations, we must abide by the guidelines we expect every business to follow. Therefore, before we can write a letter of approval for the above, we must afford the business community and our neighborhood’s citizens the opportunity to hear from such business. Therefore, before we can grant our approval, we must first hear from the above and we ask that this body grant a continuance until such hearing has occurred. So as not to greatly inconvenience the above, we ask for a short continuance in order for this hearing to take place on November 24, 2009 at 7PM. Please accept this letter as a denial letter re the above on behalf of the Mayfair Business Association (“MBA”) and Mayfair Civic Association (“MCA”). We had an opportunity to meet with the above owner, its real estate agent, its attorney and with members of the above as well as several neighbors and business owners in the community. When the above owner and his representatives first presented their case, the MBA and MCA appeared to be poised to grant its approval in their favor. However, after a surprise site check and numerous opportunities to research this business following our meeting, the MCA and MBA feel that approval is not appropriate at this time due to the following:

- Significant lack of parking at the establishment

- The MBA and MCA felt it was misled as to the type of business the above would be i.e. they likened their business to a Jennifer Convertible or a Raymour and Flanagan dealing with sales when it actually appears to be more of the type of a Rent A Center dealing almost exclusively with rental furniture see www.galleryhomestore.com.

- The proximity of an existing Rent A Center on the same commercial block shows an oversaturation of this type of business on this commercial corridor.

- The MBA and MCA felt it was misled as to the type of parking located behind the building i.e. in order to access the “six parking spots” one would have to enter a residential driveway due to the appearance of concrete pillars blocking the commercial drive.

- Their practice viewed atleast twice this past week, of illegally parking on the sidewalk adjacent to the store is unacceptable.

- The listing on its website that this location already exists before gaining acceptance from the community shows a level of arrogance not acceptable for this body.

- The statement that this business already operates several stores in Brooklyn as well as PA is an untruth.

- We recently made a phone call to their Pottstown branch and inquired as to how much a computer listed on the website was and the immediate response was the rental price.

Therefore, until the above is rectified and the community feels that this business can be truthful with them, the MCA and MBA cannot approve the Zoning petition at this time. Feel free to contact me with any questions that you may have.

We have attempted to reach out to the owner of this business on numerous occasions, to no avail. Many neighbors have come forward in opposition to this business for a myriad of reasons:

- Increased traffic on a one way street

- Type of business is undesirable on a residential block

- Already an abundance of commercial traffic on such block

- Confusion as to the directional designation of the block will only increase with this added business

- No contact from the proprietors of such business

We met on the evening of November 4, 2009 at the John Perzel Community Center. Attendees included the MBA, the MCA, the Mayfair CDC, several business owners as well as several neighbors from the surrounding blocks representing the 3300, 3400 and 3500 Blocks of Ryan Ave and the 3400 Block of Cottman. This neighborhood also has a significant amount of this type of business in a one mile radius of such proposed location. Therefore, due to the reasons mentioned above, the MCA and MBA are opposed to this business. Feel free to contact me with any questions.
